Orange County Superior Court (Trial Award)
Result: $5,600,000 to Client
B&C and Gregory G. Brown, a Board Certified Trial Specialist, obtained $5,600,000 for its client in first phase of a bifurcated trial which dealt with community property v. separate property over a family business. This was a long battle over ownership of a $157,000,000 company between family members, after husband had passed away. The second phase was to deal with breach of fiduciary duty, violation of Family Code Section 1101 and a shareholder derivative action. B&C represented the spouse of a decedent who had a community property interest in a successful manufacturing business. When her
husband died, it was learned that the business had been improperly transferred to a trust. After death, the business was then run by Trustees of the trust and wife was excluded from running the company she had help build since 1976. There were 5 defendants (and their law firms) opposing B&C in trial.
